Terms of Service

Welcome to Questic. By downloading, installing, or using the Questic app ("App") or visiting questic.app ("Site"), you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use Questic.

These Terms form a binding agreement between you and TheBairCompany ("we", "us", "our"), the company behind Questic.

1. Acceptance of Terms

By creating an account or using any part of Questic, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Questic on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

We may update these Terms from time to time. We will notify you of material changes in the app. Continuing to use Questic after a change means you accept the updated Terms.

2. Eligibility

Questic is designed for users aged 13 and older. By creating an account, you confirm that you are at least 13 years old.

If you are under 18, you should make a parent or guardian aware that you are using Questic. We encourage parents and guardians to stay informed about the apps their children use. Some in-app purchases require adult consent and a payment method. Apple's App Store handles these transactions and applies its own age controls.

If we discover that a user is under 13, we will delete their account and any associated data as soon as reasonably practicable.

3. Your Account & Responsibility

When you create an account you provide a username, email address, and date of birth. You are responsible for keeping your login credentials secure and for all activity that happens under your account.

• Choose a username that doesn't impersonate another person or brand.
• Don't share your account with others.
• Tell us immediately at legal@questic.app if you believe your account has been compromised.

We are not liable for losses caused by unauthorised use of your account where you failed to keep your credentials secure.

4. Acceptable Use & Community Rules

Questic is built on user-created quests and dares that are put to a group vote before they go live. That means you are responsible for the content you submit and the actions you take in the real world. By using Questic you agree not to:

• Create, propose, or attempt any quest or dare that is illegal, dangerous, harmful to yourself or others, or likely to cause physical or psychological harm.
• Harass, bully, threaten, or demean other users in any way.
• Submit, upload, or link to content that is sexually explicit, violently graphic, hateful, discriminatory, or otherwise inappropriate for a general audience.
• Impersonate any person or organisation.
• Use Questic to promote or facilitate illegal activity.
• Attempt to hack, scrape, reverse-engineer, or disrupt the App or its infrastructure.
• Create fake accounts, manipulate votes, or otherwise interfere with the fairness of the platform.

We reserve the right to remove content, suspend or terminate accounts, and report conduct to relevant authorities if we believe these rules have been violated.

5. Safety

Never attempt a quest or dare that could put you or anyone else at risk of injury, harm, or legal trouble. Questic quests are user-created social challenges. They are not vetted or approved by TheBairCompany before they appear in your group. The group-vote system is a peer moderation tool, not a safety guarantee.

TheBairCompany is not liable for any injury, harm, damage, or legal consequence arising from a user-created quest or dare, whether or not it was approved by a group vote. You assume full personal responsibility for your own safety and any actions you choose to take in the real world. If in doubt, don't do it.

If you see a quest or dare that you believe is dangerous or violates these Terms, please use the in-app report function immediately.

6. User Content & Proof

When you submit proof of a completed quest (photos, videos, or other media), you retain ownership of that content. By submitting it, you grant TheBairCompany a non-exclusive, worldwide, royalty-free licence to store, display, and transmit that content within the App for the purpose of operating Questic (for example, showing your proof to group members for a vote).

We do not claim ownership of your content and we do not use it for advertising without your explicit consent. Proof images are stored in private, access-controlled storage and are only visible to members of the relevant group.

You are responsible for ensuring you have the right to submit any content you upload, for example that it does not infringe the copyright or privacy rights of a third party.

7. Virtual Items, Coins, Gems & Quester Pro

Questic offers virtual currencies (coins, gems), virtual items (themes, avatar frames, accessories, boosters), and a premium subscription called Quester Pro. These are digital goods with no real-world monetary value.

• No cash value: Virtual currencies and items cannot be exchanged for real money and have no value outside the App.
• Non-refundable: All purchases of virtual items and subscriptions are final except where applicable consumer law in your jurisdiction requires otherwise.
• Apple App Store: All purchases are processed by Apple. Apple's own terms and refund policies apply. To request a refund, visit Apple's support at support.apple.com/billing.
• No transfer: Virtual items and currencies are tied to your account and cannot be transferred to another user.
• Changes: We may change the price, availability, or features of virtual items and the Quester Pro subscription at any time, with reasonable notice where possible.

8. Termination

You can delete your account at any time from the in-app settings. Deletion removes your profile and personal data in line with our Privacy Policy.

We may suspend or terminate your account if you breach these Terms, engage in conduct that harms other users or the platform, or if we are required to do so by law. In serious cases (for example, illegal activity or gross misconduct), termination may be immediate and without prior notice.

Upon termination, your right to use Questic ceases. Provisions of these Terms that by their nature should survive termination (including Sections 5, 6, 9, and 10) will continue to apply.

9. Disclaimers & Limitation of Liability

Questic is provided "as is" and "as available". To the fullest extent permitted by law, TheBairCompany disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not endorse, verify, or take responsibility for the accuracy of any user-generated content.

To the maximum extent permitted by applicable law, TheBairCompany's total liability to you for any claim arising from your use of Questic is limited to the greater of (a) the amount you paid to us in the 12 months preceding the claim or (b) €50. We are not liable for indirect, consequential, incidental, punitive, or special damages of any kind.

Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law.

10. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you via an in-app notice or email at least 14 days before the changes take effect, unless a shorter period is required by law. Your continued use of Questic after the effective date constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Belgium. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Belgium, unless applicable consumer law in your country provides otherwise.
